The U.S. Tax Court is the only place where a taxpayer can dispute an assessed tax without first having to pay the tax. Anywhere but the U.S. Tax Court, the fight is about getting a refund instead of whether or not you have to pay in the first place. To get in to U.S. Tax Court, you must receive a Notice of Deficiency, or “90 Day Letter”. This gives a taxpayer a 90 day window to file a petition with the U.S. Tax Court and dispute the results of the appeal without having to pay the tax first.
